2.1 Who We Are
ENRETA Services Pvt. Ltd., trading as Divyanushthan ("Company"), is the controller (or, where required by local law, the "business"/"organisation") responsible for your Personal Information collected through the Platform. Privacy contact: Divyanushthan@gmail.com | Phone: +91 9644081027. Registered address: 2nd Floor, Complete Academy, Mill Road, Ganj Basoda, Near Bhopal (M.P.).
2.2 Information We Collect
- •Identity and contact data: full name, email address, phone number, country, time zone, and account credentials.
- •Consultation and ritual data: date, time and place of birth; gender; family/Gotra details where relevant to a ritual; questions submitted for astrology or Vastu consultation; property layout/photographs submitted for Vastu review; and any other information you voluntarily provide for a puja, Shraddha/Pind Daan or related ritual.
- •Payment and transaction data: booking ID, service purchased, amount, currency, payment status and limited payment metadata. We do not receive or store your full card number, CVV or bank credentials — these are collected and processed directly by our payment processors.
- •Technical data: IP address, device and browser type, operating system, log data, approximate location derived from IP address, and cookies/usage data (see the Cookie Policy).
- •Communications data: support tickets, emails, WhatsApp or chat messages, and — only where lawfully permitted and with your prior knowledge and, where required, consent — recordings or transcripts of your video consultation.
- •Special category / sensitive information: birth details, religious and spiritual information, and family lineage information you choose to share are treated as sensitive. We collect this only because it is necessary to prepare your Kundli, conduct your Vastu review or perform the specific ritual you booked, and we process it only for that stated purpose.
2.3 Why We Use Your Information
To create and manage your account; process bookings and payments; schedule and conduct your video consultation; prepare astrological/Vastu analysis; coordinate rituals with the relevant Practitioner; provide customer support; verify identity and prevent fraud; comply with legal, tax and accounting obligations; resolve disputes and chargebacks; improve our Services; and, where you have not opted out and local law permits, send you service updates and marketing communications.
2.4 Legal Basis for Processing
Where required by applicable law (including UK/EU-style regimes and the DPDP Act), we process your Personal Information on the basis of your consent, the performance of a contract with you, compliance with a legal obligation, or our legitimate interests in operating and securing the Platform, balanced against your rights. You may withdraw consent at any time where consent is the basis relied upon, without affecting processing already carried out, by writing to Divyanushthan@gmail.com.
2.5 Data Minimisation and Accuracy
We collect only the birth, family and personal information reasonably necessary to deliver the specific Service you have booked. You are responsible for providing accurate birth and personal details — the accuracy of any astrological reading or ritual depends entirely on the accuracy of the information you provide.
2.6 Who We Share Information With
- •Practitioners, Pandit Jis, coordinators and translators, strictly to the extent necessary to deliver your booked Service.
- •Payment processors (for example Stripe, PayPal, Razorpay or equivalent) to process payments and refunds.
- •Hosting, cloud storage, video-conferencing (for example Google Meet/Zoom), scheduling, email/SMS/WhatsApp, analytics, security and customer-support service providers, acting on our instructions.
- •Professional advisers, auditors, insurers and regulators or law enforcement where legally required or reasonably necessary to establish, exercise or defend legal claims.
- •A successor entity in the event of a merger, acquisition, restructuring or sale of business assets, subject to equivalent confidentiality protections.
We do not sell your Personal Information to data brokers or third parties for their independent marketing purposes.
2.7 International Data Transfers
Because the Company and its Practitioners are based in India and Customers are located worldwide, your Personal Information will ordinarily be transferred to and processed in India. Where you are located in the UK, EEA, Australia, Canada or elsewhere with restrictions on cross-border data transfer, we rely on appropriate safeguards recognised under the relevant law (such as contractual data-processing terms with recipients, or another lawful transfer mechanism) before transferring your data internationally, and we will provide further information about the specific mechanism used on request to Divyanushthan@gmail.com.
2.8 Data Retention
We retain Personal Information only for as long as reasonably necessary for the purpose for which it was collected, including to satisfy contractual, tax, accounting, security, dispute-resolution and other legal obligations. As a general practice, booking, payment and consultation records (including any recordings, where made with consent) are retained for 12 months from the date of the Service, after which they are securely deleted or anonymised, unless a longer period is required by law (for example Indian tax/GST record-keeping rules) or a dispute is pending. We maintain an internal data-retention schedule by category of data.
2.9 Security
We use reasonable technical and organisational measures appropriate to the sensitivity of the data — including encrypted transmission, access controls limiting Practitioner access to booking-relevant data only, and role-based permissions — to protect your Personal Information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
2.10 Your Privacy Rights
Depending on where you are located, you may have the right to:
- •Access the Personal Information we hold about you;
- •Correct inaccurate or incomplete Personal Information;
- •Request deletion or erasure of your Personal Information ("right to be forgotten"), subject to our legal retention obligations;
- •Restrict or object to certain processing, including marketing;
- •Withdraw consent previously given;
- •Receive a copy of your data in a portable format, where applicable;
- •Lodge a complaint with your local data protection regulator (for example the ICO in the UK, the OAIC in Australia, the Office of the Privacy Commissioner of Canada, or the relevant State Attorney General/regulator in the US) in addition to contacting us directly.
To exercise any of these rights, contact Divyanushthan@gmail.com. We will respond within the time limit required by applicable law and may need to verify your identity before actioning a request.
2.11 Children
Our Services are intended only for individuals who are at least [18] years old, or the age of legal majority in their jurisdiction if higher. We do not knowingly collect Personal Information from children. If we become aware that we have inadvertently collected such information, we will delete it promptly. Parents/guardians who believe their child has provided us information should contact Divyanushthan@gmail.com.
2.12 California and US State Disclosures
If you are a California resident, the CCPA/CPRA gives you the right to know, delete, correct and opt out of the "sale" or "sharing" of your Personal Information, and the right to non-discrimination for exercising these rights. We do not sell Personal Information for monetary consideration. If we use analytics or advertising cookies that constitute "sharing" under the CPRA, we provide a mechanism to opt out through our cookie settings. Residents of other US states with comprehensive privacy laws (for example Virginia, Colorado, Connecticut, Utah and others as they take effect) have similar rights, which we will honour on a jurisdiction-appropriate basis.
2.13 Complaints
If you have a concern about how we handle your Personal Information, please contact our privacy team first at Divyanushthan@gmail.com so we can try to resolve it directly. You retain the right to escalate to your local data protection regulator regardless of whether you contact us first.
3.1 Acceptance
By accessing the Platform, creating an account, making a Booking, or clicking "I Agree" at checkout, you confirm that you have read, understood and agree to be bound by these Terms and all Policies referenced in this document. If you do not agree, you must not use the Services.
3.2 Eligibility
You must be at least [18] years old, or the age of legal majority in your country of residence (including but not limited to the USA, UK, Canada, Australia, UAE and India), and have the legal capacity to enter into a binding contract, to use the Services.
3.3 Description of Services
Divyanushthan provides online Vastu consultation, Kundli/birth-chart preparation and reading, Vedic astrology consultation, puja/path coordination and related spiritual guidance, delivered by video call. The Company acts as [a service provider that engages/coordinates independent, verified Practitioners to deliver the Service] — confirm and align this description with your actual operating model across every page of the website.
3.4 Nature of Services; No Guaranteed Outcomes
All Services are rooted in Hindu/Vedic religious, cultural, astrological and spiritual tradition. They are offered for spiritual, cultural, educational and guidance purposes. We do not guarantee any specific outcome — including but not limited to outcomes relating to marriage, health, pregnancy, wealth, career, property, litigation, immigration, or removal of any perceived affliction — as a result of any consultation, reading or ritual.
3.5 Not Regulated Professional Advice
Unless expressly stated to be provided by an appropriately licensed professional, nothing provided through the Platform constitutes medical, psychological/psychiatric, legal, financial, investment, tax or immigration advice. Vastu and astrological guidance reflects traditional and subjective interpretation and must not be treated as a substitute for advice from an appropriately licensed professional on any regulated matter.
3.6 User Conduct
- •You must not use the Platform for any fraudulent, unlawful, harassing, threatening, abusive or discriminatory purpose.
- •You must not impersonate any person, misrepresent your identity or birth details with intent to deceive, or attempt unauthorised access to the Platform.
- •You must not record, screenshot or redistribute a consultation without the Practitioner’s and Company’s consent.
- •You must not solicit a Practitioner for off-platform bookings or payments, or offer/accept unauthorised gifts, tips or "Dakshina" outside the Platform’s payment system.
3.7 Intellectual Property
All software, designs, trademarks, brand assets, written content, Kundli/astrology report templates and video/audio material provided through the Platform are owned by or licensed to the Company. You receive a limited, non-exclusive, non-transferable licence to use materials provided to you (such as your personal Kundli report) for your personal, non-commercial use only, and may not reproduce, resell or publicly distribute them.
3.8 Suspension and Termination
We may suspend or terminate your account or access to the Services, with or without notice where reasonably necessary, for suspected fraud, abuse, non-payment, breach of these Terms, or where required by law, without prejudice to any statutory right you may have.
3.9 Limitation of Liability
To the maximum extent permitted by applicable law, the Company’s total aggregate liability arising out of or in connection with the Services shall not exceed the total amount you paid for the specific Booking giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under the law of your jurisdiction — including, where applicable, liability for death, personal injury, fraud, or liability under mandatory consumer-protection law of the USA (including at FTC and state level), the UK (including the Consumer Rights Act 2015 and CMA enforcement), Australia (including the Australian Consumer Law and ACCC enforcement), Canada, the UAE, or India.
3.10 Force Majeure
The Company is not liable for delay or failure to perform caused by events beyond its reasonable control, including natural disasters, government action, internet or telecommunications failure, strikes, war, epidemic/pandemic, payment-system outages, or Practitioner emergencies. Where a Service cannot be delivered due to such an event, the Company will offer rescheduling, a substitute Practitioner, or a refund of the undelivered portion.
3.11 Changes to Terms
We may update these Terms from time to time. Material changes will be notified through the Platform or by email where required by law. Continued use of the Services after the effective date of a change constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
3.12 Severability and Entire Agreement
If any provision of these Terms is found unenforceable, that provision will be modified or severed to the minimum extent necessary, and the remaining provisions will continue in full force. These Terms, the Booking confirmation, the relevant service description, and any applicable Practitioner terms together form the entire agreement between you and the Company for the relevant Service.
This policy is designed to be fair to Customers while protecting the Company from abusive chargebacks, and to comply with mandatory consumer cancellation/cooling-off rights in the USA, UK, Canada, Australia, UAE and India where they apply to on-demand digital/personal services.
4.1 Customer-Initiated Cancellation
You may cancel or reschedule a Booking free of charge by notifying us through Divyanushthan@gmail.com or calling +91 9644081027 at least [24] hours before the scheduled appointment time. Cancellations made within [24] hours of the appointment are treated under clause 4.3 below.
4.2 Company or Practitioner Cancellation / No-Show
If the Company or the assigned Practitioner cancels, fails to attend, or is unable to deliver the booked Service, you will be offered — at your choice — a free rescheduling, a substitute qualified Practitioner, or a full refund of the amount paid for that Booking.
4.3 Late Cancellation and Customer No-Show
Because each Booking reserves a specific time slot with a Practitioner and, for certain rituals, requires advance procurement of ritual materials (samagri) and astronomical/astrological calculation, cancellations made less than [24] hours before the appointment, and Customer no-shows, are non-refundable, save for any mandatory statutory cancellation right that cannot lawfully be excluded in your jurisdiction. The Practitioner will wait in the virtual meeting room for a grace period of [10] minutes from the scheduled start time; if you have not joined by the end of that period, the session will be treated as a no-show under this clause.
4.4 Once a Consultation or Ritual Has Begun
Once a consultation, reading or ritual has commenced, the fee for that session is earned and is non-refundable on the grounds of subjective dissatisfaction with the astrological interpretation, Vastu opinion, or the outcome of a ritual performed as booked and as described. This reflects the inherently interpretive and traditional nature of these Services, as set out in the Disclaimer below, and does not affect any right you may have to a refund or remedy where the Service was materially not as described, was not performed at all, or was defective in a way recognised by applicable consumer law.
4.5 Statutory Cooling-Off / Digital Service Rights
Where the law of your country or state grants a cooling-off or cancellation-of-digital-service right, we will honour it. Where such a right lawfully ceases once you expressly request and consent to immediate performance (for example, requesting an urgent, time-sensitive consultation), we will record that consent at the time of booking.
4.6 Refund Method and Timing
Approved refunds are returned to the original payment method, normally within [7–14] business days, subject to your bank or payment provider’s own processing timelines. Currency-conversion movements and any disclosed, lawful payment-processing fee may cause the amount received to differ slightly from the amount paid; the Company is not liable for such variance where it results from your bank’s foreign-transaction charges or exchange-rate movement.
4.7 Chargebacks
If you have a concern about a charge, please contact Divyanushthan@gmail.com first so we can try to resolve it directly and quickly. Where a chargeback or payment dispute is raised that the Company reasonably considers unwarranted ("friendly fraud"), the Company may provide the payment processor with relevant records — which may include booking confirmations, IP logs, timestamped consent to this policy, session-attendance records and delivered reports — to contest the dispute. This clause does not affect any right you have to dispute a genuinely defective or undelivered Service.
5.1 What Cookies We Use
- •Strictly necessary cookies: required for login, secure checkout, currency/geo-IP detection and core site functions. These cannot be switched off as they are essential to the Platform working.
- •Preference cookies: remember your language, region, currency and display settings.
- •Analytics cookies: help us understand site usage and performance (for example, Google Analytics).
- •Advertising/marketing cookies: used to measure and improve advertising campaigns (for example, Meta/Facebook Pixel, Google Ads), where legally permitted.
5.2 Consent
Where required by applicable law (including in the UK, EU-linked processing, and US states with opt-in requirements), non-essential cookies will not be activated until you provide valid consent through our cookie banner. You can change your preferences at any time via your browser settings. Users in California and other US states with an opt-out regime may opt out of "sale/sharing" of information via cookies at any time through the same settings.
5.3 Third-Party Cookies
Certain analytics, advertising, payment, video-conferencing and security providers may set their own cookies or similar technologies when you use embedded features on the Platform, governed by their own privacy and cookie policies.
5.4 Cookie and Vendor Register
We maintain an internal, current register of every cookie and tracking vendor used on the Platform, identifying its purpose, provider, duration, category and legal basis, available on request to Divyanushthan@gmail.com.
6.1 Traditional and Spiritual Nature of Services
All astrology, Kundli/birth-chart, Vastu, puja/path and related spiritual Services offered by Divyanushthan are based on Hindu/Vedic religious, cultural and astrological tradition. They are provided for spiritual, cultural, educational and guidance purposes and are not represented as scientifically validated methods of predicting or controlling future events.
6.2 No Guaranteed Result
Statements made on the website, in advertising, by Practitioners, or in testimonials do not guarantee any particular material, financial, health, relationship or emotional outcome. Vedic astrology and Vastu interpretation are subjective and can vary between practitioners, schools of thought (sampradaya), regional traditions and individual circumstances.
6.3 Reliance on Information You Provide
The accuracy of any Kundli, astrological reading or ritual depends entirely on the accuracy of the birth date, time, place and other details you provide. The Company and its Practitioners are not liable for inaccurate outputs resulting from incorrect information supplied by you.
6.4 Not a Substitute for Professional Advice
For medical, mental-health, legal, financial, tax, immigration or other regulated matters, you should consult an appropriately licensed professional in your jurisdiction. Nothing provided through the Platform should delay or replace such professional advice.
6.5 Assumption of Risk
You acknowledge that you engage with and rely upon any guidance provided through the Platform entirely at your own discretion and risk.
6.6 Advertising Standards
The Company does not knowingly use deceptive, materially misleading, fear-based, or unsubstantiated claims in its advertising, and testimonials displayed reflect individual experiences and are not a guarantee of similar results for any other person.
7.1 Independent Contractor Status
All Pandit Jis, astrologers and Vastu consultants engaged through the Platform act as independent, verified practitioners and are not employees or agents of the Company. "Verified" means the Company has completed its stated identity, background and/or credential checks on that Practitioner — it is not a guarantee of the Practitioner’s future conduct, or of any outcome of the Service.
7.2 Conduct Standards
- •Treat every Customer with respect and comply with applicable anti-discrimination and anti-harassment law.
- •Deliver the Service as booked and disclose any material limitation in advance.
- •Never guarantee a specific outcome, and never exploit a Customer’s fear, grief, illness, or financial vulnerability.
- •Never provide medical, legal, financial or other regulated advice unless separately and appropriately licensed to do so.
- •Never request or accept tips, "Dakshina", direct bank transfers, gifts or off-platform bookings from Customers — all payments must be made through the Platform.
- •Maintain the confidentiality of Customer information and access only the booking-relevant data necessary to deliver the Service.
- •Never record or screenshot a consultation without lawful, informed consent from the Customer.
7.3 Reporting
Customers are encouraged to report immediately to Divyanushthan@gmail.com or +91 9644081027 any Practitioner who requests off-platform payment, tips or Dakshina, or who otherwise breaches these standards.
7.4 Tax and Payout Status
Practitioners are independent contractors responsible for their own tax registrations and filings, except where the Company is legally required to deduct tax at source (for example, TDS under Section 194-O of the Indian Income Tax Act on payments made through an e-commerce operator) or to withhold and report under equivalent law elsewhere. Payouts to Practitioners are subject to completed-service confirmation, applicable refunds/chargebacks, verification status and the Company’s payout schedule.
7.5 Investigation and Removal
The Company may investigate any complaint against a Practitioner, and may restrict, reassign, suspend or permanently remove a Practitioner from the Platform where reasonably necessary, including for safety, fraud, or repeated policy violations.
8.1 Accurate Information
You must provide accurate name, contact details, service selection, date/time, time zone and — for astrology/Vastu/ritual Services — accurate birth or property details. The Company and Practitioners are not liable for outcomes affected by inaccurate information you supply.
8.2 Booking Confirmation
A Booking is confirmed only once the Platform issues a confirmation and payment has been successfully processed. Please check your confirmation email/message for the correct date, time and time zone.
8.3 Time Zones
All appointment times are shown converted to your local time zone based on the information you provide or your device settings; you are responsible for verifying the correct local time on your Booking confirmation.
8.4 Video Consultations
Services are delivered online via video-call platforms such as Google Meet (or an equivalent tool nominated by the Company). You are responsible for ensuring you have a compatible device, stable internet connection, and a suitably private setting for your consultation. Technical outages on either side may require rescheduling and will be handled in good faith, including in accordance with clause 4.2.
8.5 Late Arrival
If you join late, your session may be shortened to end at the originally scheduled time where the Practitioner has a subsequent booking, as described in clause 4.3.
8.6 Full Upfront Payment
All Services must be paid in full at the time of Booking. This secures the Practitioner’s dedicated time and, for ritual Services, covers the advance cost of any required samagri (ritual materials) and preparatory astronomical/astrological calculation.
8.7 Ritual-Specific Information
For Shraddha, Pind Daan and similar rituals performed on your behalf, the Company may request names, relationships, dates and Gotra details reasonably necessary to correctly perform and coordinate the ritual.
8.8 Substitution
Where reasonably necessary (for example, due to illness or unavailability), the Company may assign a suitably qualified substitute Practitioner, and will give you notice of the substitution where practicable.
9.1 Availability
Services are offered to Customers in India and internationally, including the USA, UK, Canada, UAE and Australia, subject to legal, payment, operational and Practitioner availability in the relevant country.
9.2 Your Responsibility for Local Law
You are responsible for ensuring your use of the Services is lawful in your location. The Company may restrict or decline to provide Services in any location where required by law, sanctions, payment-network rules, or regulatory requirements.
9.3 Not Immigration or Travel Advice
Online Services do not constitute or include visas, immigration advice, or any guarantee of entry into any country.
9.4 Currency, Pricing and Taxes
Prices may be displayed in your local currency (for example USD, GBP, CAD, AUD, AED) based on your detected location, with final checkout processed in the displayed currency. Applicable GST (India), VAT, sales tax, digital-services tax, or withholding tax may apply depending on the transaction and your location; any minor discrepancy on your bank or card statement is typically due to your bank’s own foreign-transaction fee or the exchange rate applied at the time of your bank’s processing, for which the Company is not liable.
9.5 Cross-Border Data Processing
As described in the Privacy Policy, your Personal Information may be processed in India and other countries using appropriate safeguards where required by the law of your location.
9.6 Sanctions Compliance
The Company does not knowingly offer Services to individuals or entities located in, or ordinarily resident in, a comprehensively sanctioned jurisdiction under applicable export-control or sanctions law (including US OFAC sanctions, UK, EU, Australian or UN equivalents), and reserves the right to decline or cancel a Booking where it reasonably believes this restriction applies.
9.7 United States
US consumer-protection and privacy obligations vary by state. Advertising and data practices are reviewed with reference to Federal Trade Commission guidance and applicable state consumer-protection and privacy statutes (for example in California, Virginia, Colorado, Connecticut and Utah) based on where Customers are actually targeted and located.
9.8 Canada
PIPEDA and applicable provincial privacy and consumer-protection law (for example in Quebec, British Columbia and Alberta) may apply depending on the nature of the transaction.
9.9 United Kingdom
UK GDPR and the Data Protection Act 2018 apply to processing connected with UK Customers, including the UK’s specific rules on restricted international data transfers; the Consumer Rights Act 2015 and other UK consumer law apply to Services supplied to UK consumers as far as legally mandatory.
9.10 Australia
The Privacy Act 1988 and Australian Privacy Principles, and the Australian Consumer Law (including consumer guarantees that cannot be excluded), apply to the extent the Company’s activities fall within their scope.
9.11 United Arab Emirates
UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data, together with applicable e-commerce, consumer-protection and electronic-transaction rules (including any relevant free-zone rules, if applicable to the Company), apply to Services supplied to UAE-based Customers.
9.12 India
The Company, its GST registration, invoicing and export-of-services classification for cross-border digital consultations, and its obligations under the Digital Personal Data Protection Act 2023 and Rules, the Consumer Protection Act 2019 (including its E-Commerce Rules) and FEMA (for cross-border payment receipt), should be confirmed with Indian tax and legal counsel based on the Company’s actual registration and revenue model before international launch.

10.6 Safety and Urgent Concerns
Urgent concerns about fraud, abuse or safety should be reported immediately to Divyanushthan@gmail.com or +91 9644081027. We may take protective action, including suspending an account, and will report to relevant authorities where legally required or permitted.
To deliver the Services globally, the Company uses the following categories of third-party processors. By using the Platform, you acknowledge that your data will be processed by these providers for the purposes described.
- •Payment gateways/acquirers (for example Stripe, PayPal, Razorpay) — to process payments and refunds. These providers are PCI-DSS compliant and we do not store your full card number or CVV.
- •Scheduling and communication tools (for example Calendly-type scheduling, WhatsApp Business) — to coordinate booking times across time zones and provide support.
- •Video-conferencing providers (for example Google Meet, Zoom) — to deliver the live consultation.
- •Hosting, cloud storage and backup providers — to run and secure the Platform.
- •Analytics and advertising providers (for example Google Analytics, Meta/Facebook Pixel) — to measure site performance and campaign effectiveness, subject to your cookie choices.
- •Customer-relationship-management and support-ticketing providers.
- •Professional advisers — lawyers, accountants, auditors and insurers, where necessary.
11.1 Processor Agreements
Where required by applicable law, the Company enters into written data-processing agreements with these providers covering confidentiality, security, permitted use, sub-processing, data return/deletion, breach-notification assistance and, where relevant, international-transfer safeguards.
11.2 Sub-Processor Register
The Company maintains a current internal list of sub-processors and the countries in which they process data, available on request to Divyanushthan@gmail.com, and will provide notice of material changes where required by applicable law or contract.
11.3 Data Breach Response
The Company maintains a documented incident-response process covering identification, containment, investigation, evidence preservation, remediation, and notification to affected individuals and regulators within the time frames required by applicable law (for example, without undue delay under UK/EU-style regimes, and as required under the DPDP Act, US state breach-notification statutes, and other applicable law).
11.4 Records
The Company keeps appropriate records of consent, privacy notices issued, processor agreements, data-subject requests, complaints, refunds, security incidents and Practitioner verification checks.
12.1 Governing Law
These Policies are governed by the laws of India, and specifically by the laws of the state of Madhya Pradesh, without regard to conflict-of-law principles, and expressly excluding the United Nations Convention on Contracts for the International Sale of Goods.
12.2 Dispute Resolution Process
If a dispute arises, you agree to first attempt to resolve it informally by contacting Divyanushthan@gmail.com / the Grievance Officer. If not resolved within 30 days, either party may pursue the matter as follows: the competent courts. Subject to clause 12.3, the courts of Bhopal, Madhya Pradesh, India shall have exclusive jurisdiction over any dispute not resolved through the above process.
12.3 Mandatory Consumer and Privacy Rights Are Not Excluded
Nothing in this clause removes, limits or excludes any mandatory statutory right, consumer protection, or privacy right that you have under the law of your country of residence and that cannot lawfully be waived or displaced by a choice-of-law or choice-of-forum clause — including, where applicable, rights under the Consumer Rights Act 2015 (UK), the Australian Consumer Law, US federal and state consumer-protection statutes, Canadian provincial consumer-protection law, and UAE consumer-protection law. Where a mandatory rule of your local law would apply regardless of this clause, that mandatory rule prevails to that limited extent, and the remainder of this clause continues to apply.
12.4 Severability
If any provision of these Policies is held invalid or unenforceable by a court or regulator of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be so modified, and the remaining provisions will continue in full force and effect.
